Terms of Use

These terms are an agreement between you and Atlas Texturing ("Atlas", "we"), Vancouver, British Columbia, Canada. They cover the Atlas plugin for Adobe Substance 3D Painter, the Atlas service and your account at atlastexturing.com. By creating an account or using Atlas, you accept them.

1. What Atlas is

Atlas is a texturing tool for professionals. Inside Substance 3D Painter it captures views of your model, generates images from them with AI models, and brings the results back onto your model. Atlas is in beta: features change, and some may be added, changed or removed without notice.

We grant you a personal, non-transferable licence to install and use the plugin on computers you control while your seat is active. Atlas includes open-source components; their licences are listed in the third-party notices file installed with it.

2. Who may use it

You must be at least 18 years old. An account is for one person. You may sign in from more than one computer, but you may not share your account or let anyone else use it. You are responsible for everything done under your account. If you believe someone else has access, sign out everywhere from the account page and contact us.

3. Plans, balances and payment

• The seat. Atlas is sold as a monthly seat at the price shown at checkout, plus applicable tax. The seat renews monthly until you cancel it on the account page; a cancelled seat runs to the end of the period already paid.
• The trial. A new account may start one free trial. It converts to a paid seat when the trial ends unless you cancel before then.
• Generation balance. Each seat period adds an included balance, up to a cap. You may buy additional balance at any time; purchased balance does not expire while your account exists. Included balance is used before purchased balance.
• Prices. Every generation shows its price before it runs, and that price is what is charged. A generation that fails for a technical reason is not charged. A result you receive is a result, whether or not you like it.
• Granted balance. Balance we grant free of charge may end on a date we set or be withdrawn, and is never refundable.
• Spending limit. You may set a monthly spending limit on the account page; generation pauses for the month when it is reached.
• Failed payments. If a payment fails, generation pauses until it is paid; the seat ends if it stays unpaid.
• Payment. Payments are processed by Polar, our reseller and merchant of record, which handles tax, invoices and receipts under its own terms. Atlas never sees your card details.
• Refunds. A subscription payment is refunded in full if you ask within 14 days of being charged and you have not used more than that month's included balance, once per customer; the plan then ends at once. A top-up is refunded in full if you ask within 14 days of buying it and none of it has been spent; once any of it has been spent it is not refunded, in whole or in part. The Refund Policy has the details.
• Price changes are announced on the account page at least 30 days before they apply to you.

4. Your content and your results

• Your content is yours. The models, images and text you work with stay yours. Your meshes never leave your computer; Atlas sends rendered views and text to generate.
• Results are yours to use, including commercially. Atlas claims no rights in them. AI models can produce similar images for other people, so no result is guaranteed to be unique, and no one guarantees that a result infringes no third-party right. You are responsible for the content you bring to Atlas, for how you use what you create, and for claims arising from either.
• AI providers. To generate, Atlas sends the images and text of a request to a third-party AI model provider. Providers do not train on your requests under the terms Atlas has with them; they may keep limited logs to detect misuse. The Privacy Policy has the details.
• Contributions. The account page has a switch, off by default, to contribute your runs to an Atlas dataset in exchange for a bonus on purchases. Only with the switch on are your runs kept beyond what a request needs. You can turn it off, and delete what you contributed, at any time.
• Feedback. Suggestions you send us may be used without obligation to you.

5. What you may not do

You may not use Atlas to create or work with content that sexualises or harms minors; depicts a real person sexually without consent or impersonates a real person to deceive; is pornographic; promotes violence, terrorism, self-harm, hatred or harassment; infringes someone's copyright, trademark or privacy; or is unlawful where you are or where we are.

You also may not share, resell or lend your access; reverse engineer, decompile or copy Atlas; circumvent its safety measures, limits or required updates; use it to build or train a competing AI model; or run automated bulk generation outside the tool's own workflow.

If you break these rules, we may refuse generations, suspend or close your account, and report content where the law requires it.

6. Availability

Atlas depends on third-party services. We may add, change, pause or retire models and features, and we may require a minimum plugin version. We do not promise that Atlas is available at all times or free of errors.

7. Ending the agreement

You may stop at any time: cancel your seat on the account page and, if you wish, ask us to delete your account. We may suspend or end your account if you break these terms or the law requires it. If we end your account for any other reason, we refund your unused purchased balance.

8. Liability

To the extent the law allows, Atlas is provided as is. We are not liable for indirect or consequential loss, lost profits, or what you do with generated results. Our total liability to you for anything arising from Atlas is limited to the amount you paid us in the twelve months before the claim. Nothing in these terms removes rights the law gives you as a consumer, or limits liability for fraud, or for death or personal injury caused by negligence.

9. Law and disputes

These terms are governed by the laws of British Columbia and Canada, and disputes are heard by the courts of British Columbia, except where the law where you live gives you, as a consumer, its own protections and courts. Contact us before taking any formal step.

10. Changes to these terms

We post new versions at atlastexturing.com/terms with their date. For changes that affect you materially, we give notice on the account page or by email at least 14 days before they take effect. Using Atlas after that date means you accept them.
